What Is Divorce Mediaton?

Mediation is a voluntary and collaborative process through which the parties engaged in a conflict reach resolutions together. These resolutions are based on a mutual understanding of each party's needs and interests as well as the reality of the issues the parties face.  

In divorce mediation, the couple works with the mediatiors to analyze the complete economic picture and come to a financial agreement that is realistic, reasonable and workable. With regard to parenting arrangements, the goal is to provide a structure, unique to each family that allows each parent to develop and nurture the optimal relationship with the children. The specific arrangements will determine how major decisions regarding the children's welfare are handled, when the children spend tilme with each parent, and how the children will be supported financially. 

How Does The Mediation Process Work?

Couples meet with the mediators for a series of sessions, the number of which depends on each couple. The goal of the mediation process is to craft a separation agreement that serves as the basis for the divorce. In Family Mediation, the mediators will co-mediate with the couple. The mediators at Family Mediation are attorneys who are available to draft a separation agreement based on the outcome of the mediation sessions. 

What Is The Role Of The Mediators?

Throughout the process, two mediators work together with the couples to facilitate negotiations. The co-mediators maintain a neutral and non-coercive role throughout the process, but are active participants, listening to the needs and interests of each party and helping the couple to analyze and generate ideas for going forward. It is the co-mediators goal to assist the parties in arriving at a settlement that best serves their own interests.

Is Mediation Right For Us?

Mediation is an alternative to litigation for couples motivated to negotiate the terms of their separation agreement and divorce in a timely and cost effective manner. It is also an attractive means of resolution for those who would like the opportunity to craft personalized terms to the settlement of their conflict. Further, Family Mediation mediates post-divorce conflicts and matters of custody, child support and asset division for unmarried couples and domestic partners.

What Is The Role Of The Law In Mediation?

It is our philosophy that the law is a fundamental point of reference thoughout the entire process. Any agreement reached must comply with New York State law. However, within that requirement, there is a lot of room for tailoring agreements specific to the individual's needs. In other words, the law provides a frame of reference, but need not limit the terms of the financial and parenting arrangements.
